The category of legal assets also includes water, a naturale resource of incredible importance for the life of every human being. The right to water is a fundamental one for every person, and this requires a legal framework aimed at protecting it and regulating its use. Also about waters, considered in their variety and plurality, a form of belonging can be identified: it can be traced back to collective ownership, a concept that goes beyond the one of individual and exclusive ownership and enhances the participation of the community that owns the water assets in the management and enjoyment of the asset itself. Today, the debate is even more enlivened by the law n.168, 20 november 2017, on collective domains, defined as the primary legal order of the original communities. This law classifies collective goods, and among them it includes the water bodies on which residents exercise civic uses. The regulation of water bodies within the rules on collective domains allows a greater protection of water resources as assets for collective enjoyment, primary tools for development and conservation of the natural heritage.
