LAVORO AUTONOMO E CONTRATTO D'OPERA: MODELLI NEGOZIALI E CONTESTI SOCIO-ECONOMICI

The contract for work constitutes the negotiating framework through which self-employ-ment develops within a market that increasingly demands its services. This is because the digital era, on-line platforms, social networks, artificial intelligence and different lifestyles also linked to the past pandemic require new goods and new services that self-employed workers are called upon to perform by a client who is very often an entrepreneur. However, the agreed conditions, the manner in which the service is carried out, the impossibility of influencing the content of the contract place the self-employed worker in an inadequately protected legal position, to the point of making him a poor worker or even a false self-employed worker, i.e. a worker who draws only disadvantages from the autonomy and independence that ideally characterise him. The European Union, the national legislator, but above all judicial interpretation can help to change the described reality and intervene for an adequate recognition of the value and qualities of the work contract.
